Petitioner has filed this writ petition, seeking following reliefs:- 10.1 That, this Hon’ble Court may kindly be pleased to issue an appropriate writ by directing the respondent authorities to consider the case of the petitioner and recalculate the pension and other retiral benefits by calculating the services of the petitioner rendered as temporary employee since 01.01.1978 in the interest of justice. OR In alternate, the petitioner may kindly be permitted to raise all disputes before the competent authority i.e. respondent no. 4 to 7 by filing a representation and they may kindly be directed to take a decision on the representation of the petitioner as per law within six weeks from the date of order. 10.2 Any other relief which this Hon’ble Court may deem fit and proper in favour of the petitioner may kindly be passed.” 2. Learned counsel for petitioner submits that petitioner was initially appointed as daily wage employee with respondent department in the year 1978. After continuous regular service as daily wage employee he was regularized from 13.10.1998. Petitioner stood retired from service 3 / 3 after attaining the age of superannuation on 31.05.2021. After retirement petitioner was paid retiral dues completing the period of service i.e. in the year 1998 and not from the date of initial appointment. She further submits that her case is covered with the decision of Hon’ble Supreme Court in case of Netram Sahu V. State of Chhattisgarh decided on 23.03.2018 in Civil Appeal No. 1254/2018 and, therefore, direction be issued to respondents to consider the representation submitted by petitioner on 25.04.2025 at the earliest, in a specified time frame. 3. Learned counsel for State submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection. He however submits that the decision of Hon’ble Supreme Court in case of Netram V. State of Chhattisgarh (supra) is pending consideration before the larger Bench. 4. On due consideration of submission made by learned counsel for the respective parties, nature of grievances raised and limiter prayer made by learned counsel for the petitioner, I find it appropriate to dispose of this writ petition at this stage, directing respondent no. 7 to consider and take decision on representation submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of three months from the date of receipt of the copy of order. 5.
