This is an application filed under Section 24 of the Code of Civil Procedure at the instance of the petitioner-husband. As can be seen from the averments made in the petition and also borne out of from the record that there is a domestic violence proceedings initiated by the respondent/wife bearing PWDVA No.A-34/2020 before the learned Judicial Magistrate First Class, Kelapur, District – Yavatmal. 2. It can also be seen that an appeal challenging the judgment and decree of the Family Court, Nagpur, at present pending before this Court. In the backdrop of this fact, the present application is moved. Prity

3. I have heard Shri Bhoskar, learned counsel for the applicant, who has argued in support of the contentions made in the application. 4. It is his primary contentions since the respondent/wife is serving at Nagpur, it would be also convenient for her to get the proceedings pending at Kelapur be transferred to Nagpur. 5. When confronted the learned counsel for the respondent counters the said submissions. She states that she is a permanent resident of Kelapur and that the proceedings are pending and her residence at Nagpur is only temporary in nature. She, therefore, opposes the contentions made in the application. 6. In the backdrop of the said fact, I am not inclined to allow the said application. 7. Mr. Bhoskar, learned counsel for the applicant, however, relies on the order of this Court in Misc. Civil Application No.890/2025, where this Court in the facts of said case, allowed the application of the petitioner/husband therein. However, the glaring difference in the said fact was that in the said matter, a petition was pending before the Family Court at Nagpur, which was initiated by Prity
3 / 3 17.mca360.2026 the husband and therefore, in the said factual backdrop, the Court allowed the application by the husband, here it is not the present case. 8.
Admittedly, there is nothing pending before the Family Court albeit an appeal filed before this Court. The said fact will have a strong bearing on the outcome of the present case. As I have stated supra, there is nothing to show by the petitioner/husband to seek transfer, the application is, therefore, rejected. [ NANDESH S.
