This petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce the daughter of the petitioner, namely, Ms.Sunaina, aged around 24 years, who is stated to have been illegally and unlawfully taken into custody by the This is a digitally signed order. On advance notice of this petition, Mr.Sanjay Lao, the learned senior counsel appearing for the respondent nos.1 and 2, submits that information at Police Station- Uttam Nagar was given vide GD No.0142 regarding the arrival of the officers from the Rajasthan Police in relation to FIR No.13/26 under Sections 318/319/336 and 340 of the Bharatiya Nyaya Sanhita, 2023 and Sections 66(c) and 66(d) of the Information Technology Act, 2000, registered at Cyber Police Station, Deeg, Bharatpur. The Rajasthan Police apprehended 83 persons, including the daughter of the petitioner, on 30.08.2026, and left from Rajasthan on the same day. These facts were also recorded in the GD No.0049A and 0062A of 30.08.2026 at Police Station: Uttam Nagar. 3. As the daughter of the petitioner is in custody of the Rajasthan Police and as far as the Delhi Police is concerned, the inter-State arrest guidelines have been followed, therefore, no further directions can be passed in the present petition. The petitioner may approach the appropriate court for availing his legal remedies. 4. The petition is disposed of in the above terms.
