The petitioner is apprehending his arrest in connection with Patratu P.S. Case No.222 of 2023, registered for the offence under Sections 420, 406, 467, 468, 471 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class, Ramgarh. 3. Learned counsel appearing for the petitioner submits that the petitioner is innocent and he has committed no offence. He further submits that the petitioner happened to be driver of the contractor and false allegations are made of using debit (ATM) card at Kolkata during the period from 24.12.2023 to 26.12.2023. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner’s mobile location was found in Kolkata wherefrom the amount has been withdrawn through debit (ATM) card. He also submits that the said account is of Panchayat Samiti, Patratu and if the Government account is there, kits are not being handed over to the account holder, however, in the present case in connivance with other person the kit has been ( 2026:JHHC:18326 ) -2- A.B.A. No. 2038 of 2026 handed over and fraudulently the amount has been withdrawn. He next submits that the kit aspect has also come in para 114 of the case diary. 5. In para 60 of the case diary, it has come that the mobile’s location of the petitioner was found at Kolkata during the period when the amount has been fraudulently withdrawn. The said account is of Panchayat Samiti, Patratu and kits are not being handed over to the Government account’s holder, however, in the present case the kit has been handed over and fraudulently the amount has been withdrawn. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected. 6.
