Bano, District Simdega. 4. Suresh Bhuiyan, son of Late Junas Bhuiyan, R/o, Hathinghore, Jharkhand. P.O. & P.S.Bano, District- Simdega, … Respondent(s). CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Ms. Priya Saw, Advocate Mr. Raj Nandan Chatterjee, Advocate For the State : Mr. Ankit Kumar, AC to SC-I …...... 05 /23.06.2026: Heard the learned counsel representing the petitioner and the learned counsel representing the respondents. 2. The petitioner is aggrieved by the order passed by the Circle Officer, Bano, District Simdega whereby the land has been refused to be mutated in the name of the petitioner on the ground that the land is recorded in the name of Junas Bhuiyan who is the ancestor of the respondent no. 4 herein. The Appellate Authority has also upheld the aforesaid finding. 3. After hearing the parties, I find that the factual aspect of the orders passed by the Revenue Authorities are against the petitioner. The petitioner claims title over the land in question on the basis of settlement whereas the authorities found that prima- facie the same belongs to the ancestor of the respondent no. 4. 4. The aforesaid fact suggests that there is title dispute between the parties. The petitioner now in view of the aforesaid 2026:JHHC:18324 2 background has to establish his title then only proper order in the petition can be passed. This type of disputes can only be resolved in the title suit where evidence needs to be adduced. Thus, I direct the petitioner to approach the appropriate Civil Court having competent jurisdiction who will decide the right, title and interest of the land in question on its own merits. 5. The Civil Court will decide the claim of the petitioner and it is expected that the Revenue Authority will be abide by the order passed. 6. Accordingly, this writ petition is disposed of.
