1. Applicant has filed this third bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as he has been arrested in connection with Crime No. 684/2022 registered at Police Station – Kharsiya, District Raigarh (C.G.) for offence punishable under Section302, 449, 427/34 of IPC.
2. Case of prosecution in brief is that on 26.12.2022 over a land dispute applicant along with other co-accused namely Kartikaram Dansena entered into the house of Gendlal Dansena and assaulted him with club and axe and committed murder of Gendlal thereby the offence was committed. Learned counsel for applicant submits that applicant is in jail since 26.12.2022, only 15 witnesses out of 30 are examined before the trial Court. Trial may take some time, hence, applicant may be enlarged on bail.
4. On the other hand, learned State counsel opposes the submission of learned counsel for applicant and further submits that eye-witnesses PW-1, Chhatrapal Dansena and PW-3, Suresh Dansena, examined before the trial court have supported case of prosecution.
5. Having considered the submission of learned counsel for the respective parties, evidence of witnesses PW-1 and PW-3 and the manner in which the offence is committed, I do not find present to be a fit case to allow this bail application.
6. Accordingly, this bail application is dismissed. However, taking into
consideration the period of detention of applicant, learned trial court is
directed to expedite the trial and to take all necessary steps and measures for causing presence and examination of remaining prosecution witnesses as provided under the B.N.S.S. Sd/- (Parth Prateem Sahu) pwn
