HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE RAVI CHIRANIA
Order 08/01/2026
Learned counsel for the petitioner submits that the Central Administrative Tribunal has wrongly disposed of the contempt petition filed on behalf of the petitioner solely on the ground that a review petition against the original order is pending before the Tribunal. It is, therefore, prayed that the matter be remanded back to the Tribunal for deciding the contempt petition afresh.
Learned counsel for the respondents has opposed the
submissions advanced by learned counsel for the petitioner. We have heard learned counsel for the parties and perused the material available on record. Taking into account the facts and circumstances of the present case, we are of the considered view that the approach
[2026:RJ-JP:591-DB] (2 of 2) [CW-7804/2025] adopted by the Tribunal is unsustainable. Admittedly, Review Petition No.03/2024 filed by the Union of India against the original
order passed by the Tribunal is pending consideration. Merely because a review petition is pending, the contempt petition could not have been disposed of in the manner done. Accordingly, we deem it just and proper to allow the writ petition. The order dated 12.12.2024 passed by the Tribunal is hereby set aside, and the matter is remanded back to the Tribunal for fresh consideration. The Contempt Petition No.52/2023 is restored to its original number. The Tribunal is directed to decide Contempt Petition No.52/2023 along with Review Petition No.03/2024. Both parties are directed to appear before the Tribunal along with a certified copy of this order on 20.01.2026. The Tribunal is further directed to decide both the matters expeditiously.
