2026:JHHC:18316 1 IN THE HIGH COURT OF JHARKHAND, RANCHI ---- A.B.A. No. 3271 of 2026 ---- Saniya Naaj, aged about 32 years, d/o Mansoor Alam, resident of Village Koderma, (Beherwatand), PO and PS -Koderma, District Koderma, Jharkhand .... Petitioner -- Versus -- The State of Jharkhand .... Opposite Party ---- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI --- For the Petitioner :- Mr. Krishna Kumar, Advocate For the State :- Mr. Manoj Kumar Mishra, Advocate ---- 2/23.06.2026 Heard learned counsels for petitioner and for State. 2. The petitioner is apprehending his arrest in connection with Koderma PS Case No.275 of 2022, for offence registered under section 409, 420, 467, 468, 471 of the IPC, pending in court of learned Chief Judicial Magistrate, Koderma. 3. Learned counsel for the petitioner submits that the petitioner has earlier moved before this Court in ABA No.7522 of 2023 which was dismissed as withdrawn by order dated 04.10.2023 and ABA No.2845 of 2024 which was further dismissed as withdrawn by order dated 23.01.2025. He next submits that false allegations are made against the petitioner of withdrawal of Rs.15,50,000/- which is said to be pre-matric scholarship amount. He next submits that the allegation is made against 14 schools and 2026:JHHC:18316 2 the petitioner is said to be the Head-Mistress of one of the school. He also submits that with respect to one of the co-accused, interim protection has been made absolute by Hon’ble Supreme Court. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned State counsel opposes prayer and submits that twice the anticipatory bail application of the petitioner was dismissed as withdrawn as aforesaid and there is no fresh ground to entertain the present anticipatory bail application. He also submits that the petitioner has also not stated anywhere that the petitioner is cooperating in the investigation. On these grounds he submits that anticipatory bail to the petitioner may kindly be rejected. 5. Admittedly, the petitioner has earlier twice moved before this Court in ABA No.7522 of 2023 which was dismissed as withdrawn by order dated 04.10.2023 and ABA No.2845 of 2024 which was further dismissed as withdrawn by order dated 23.01.2025 respectively, and what has been argued by the learned counsel appearing on behalf of the petitioner that point was already available to the petitioner and thereafter the earlier two anticipatory bail applications were withdrawn. Thus, there is no fresh ground to entertain the present anticipatory bail application on behalf of the petitioner and further the Hon’ble Supreme Court has made the interim protection absolute with regard to one of the co-accused as 2026:JHHC:18316 3 she was cooperating in the investigation. In the present application, there is no averment that the petitioner is cooperating in the investigation whereas the earlier two of the anticipatory bail applications were dismissed as withdrawn by order dated 04.10.2023 and 23.01.2025, respectively and there is no fresh ground to entertain the third anticipatory bail application of the petitioner and as such, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer of the petitioner for anticipatory bail is, hereby, rejected and consequently, the instant anticipatory bail application being A.B.A. No.3271 of 2026 is, hereby, dismissed.
