National Highways Authority of India Vs. Pritam Singh OMP(M) No. 275 of 2026 28.7.2026 Present: Ms. Shreya Chauhan, Advocate, for the applicant. Mr. Ram Kumar, Advocate, for the non- applicant. This is an application filed for condonation of delay in filing the appeal. It has been contended in the application that the impugned judgment was passed on 2nd September, 2024. As per the case of the applicant, certified copy of the judgment was applied by the counsel on 7th October, 2025, and the same was prepared on 10th October, 2025 and thereafter the same was delivered on 18th October, 2025. It is the case of the applicant that despite disposal of the case, the same was not within the knowledge of the applicant, as the same was never intimated to them by their counsel. That earlier also, due to inefficiency and lackadaisical attitude of the law firm, as many as 362 cases pending in the Court were withdrawn from the law firm, namely M/s M.V. Kini and Company and were allotted to M/s Nishaank Mattoo and Associates, vide letter dated 20th September, 2023. Further, it is the case of the applicant that the certified copy was received in October 2025 and thereafter the applicant contacted its panel counsel to obtain the record; however, due to lack of cooperation from the said counsel, there was considerable delay in preparing the entire record for filing of the appeal. It is the case of the applicant that delay in filing the appeal is neither intentional nor willful, but the same has occurred under the aforesaid circumstances. The counsel for the non-applicant has no objection in case the present application is allowed. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit, the same is allowed and delay in filing the appeal is condoned. The application stands disposed of. Appeal be registered. Arb. Appeal No____of 2026 Admit. Call for the record. List in due course. OMPST No. 4024 of 2026 Be registered. Heard. Subject to deposit of the entire amount by the applicant in the Registry of this Court within a period of eight weeks, the operation, implementation, and execution of the impugned judgment dated 2.9.2024 as well as arbitral award dated 20.4.2023 during the pendency of the appeal shall remain stayed.
