Heard the parties.
The petitioner has been made accused in connection with Dumri P.S. Case No.24 of 2025 (S.T. Case No.219 of 2025) registered for the offences punishable under Section 103 (1), 109, 117 & 3 (5) of the B.N.S., 2023.
This is the second journey of the petitioner with the self-same prayer as earlier the prayer for regular bail of the petitioner was rejected on merit vide order dated 28.11.2025 in B.A. No.7312 of 2025.
Learned counsel for the petitioner submits that the fresh ground is that in the meanwhile, three witnesses have been examined and they have categorically stated that Jitam Aind has committed the murder of Bifai Vishal Aind during the course of the quarrel between them and have not stated anything to implicate the petitioner in this case. It is submitted that the allegation against the petitioner is false. It is next submitted that the petitioner has not committed any overt act to be implicated in this case. It is also submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 16.06.2026 passed in B.A. No.5264 of 2026. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 13.06.2025 as
has been mentioned in para-01 of the instant bail application. Hence it is submitted that the petitioner be released on bail.
Learned Addl. P.P. opposes the prayer for bail.
Considering the facts of this case, the above-named petitioner is
directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge V, Gumla in connection with Dumri P.S. Case No.24 of 2025 (S.T.
