JUSTICE ASHOK S.KINAGI ORAL ORDER The General Manager of petitioner No.1 and respondent No.2 are present before the Court, and they are identified by their respective counsel. 2. The General Manager of petitioner No.1 and respondent No.2 have filed a compromise petition, which reads as follows: A. The Respondent No 2 herein, who had been dismissed from service vide order dated 30.10.1999, raised a dispute before the Respondent No 1, challenging the said order of dismissal. B. The Respondent No 1 passed the order at Annexure F to the writ petition dated 22.07.2008, thereby setting-aside the order of dismissal, with a direction to the Petitioners to impose punishments from the date of dismissal commensurate to the misconduct committed by the Respondent No 2 and Petitioners to reinstate the Respondent No 2 and pay consequential service and monetary benefits. - 4 - HC-KAR NC: 2026:KHC:11196 WP No. 12827 of 2021 C. The challenge laid to the said order at Annexure F has been turned down by the Hon'ble Karnataka Appellate Tribunal in Appl. No.689/2008 and R.P. No.5/2017, as per Annexures J and L to the writ petition. As such, calling in question the order of the Respondent No. 1 at Annexure F and the orders of the Hon'ble Karnataka Appellate Tribunal at Annexures J and L, the Petitioners have preferred the above writ petition. D. With the intervention of the elders and the well- wishers, the petitioners and the Respondent No 2 have amicably resolved the dispute as under: 1. The Petitioners have agreed to pay and the Respondent No 2 has agreed to receive a sum of Rs.10,50,000/-(Rs. Ten Lakhs Fifty Thousand only) towards full and final settlement of all the claims of the Respondent No.2. 2. The Respondent No.2 undertakes that, he would not make any past, present, or future claim against the petitioners whatsoever and this settlement is arrived at in full and final satisfaction of all his claims. The Respondent No.2 submits that he would not make any claim for back wages, re-instatement, gratuity, or any such terminal benefit from the Petitioners. - 5 - HC-KAR NC: 2026:KHC:11196 WP No. 12827 of 2021 3. The aforesaid sum of Rs.10,50,000/- (Rs. Ten Lakhs Fifty Thousand only) has been paid by the Petitioners to the Respondent No.2 through Pay order bearing No.240781 drawn on Sri Sudha Co-operative Bank Ltd. Bank, Jayanagara Branch, Bengaluru, dated 23.02.2026. The Respondent No 2 acknowledges its receipt. 4. This compromise petition has been entered into on the own volition of the parties, without there being any coercion, misrepresentation, or undue influence. Wherefore, it is respectfully prayed that this Hon'ble Court be pleased to record the above compromise and dispose of the writ petition in terms of the compromise petition, thereby setting aside the impugned orders at Annexure F dated 22.07.2008 passed by the Respondent No.1 Authority, Annexure J dated 18.04.2017 passed in Appeal No 689/2008 and Annexure L dated 22.11.2019 passed in Review Petition No. 5/2017 by the Hon'ble Karnataka Appellate Tribunal, in the interest of justice and equity. 3. The contents of the compromise petition is read over, and explained to the parties in Kannada language - 6 - HC-KAR NC: 2026:KHC:11196 WP No. 12827 of 2021 known to them. They have accepted the terms and conditions of the compromise petition, and accordingly, prays to dispose off the instant petition in terms of the compromise petition. 4. The compromise petition is taken on record. 5. Perused the compromise petition, and I am satisfied that the terms and conditions of the compromise petition are lawful. In the circumstances, I do not find any legal impediment to accept the compromise arrived at, between the parties. 6. The General Manager of petitioner No.1 handed over the pay order of Rs.10,50,000/- in the name of respondent No.2 vide pay order bearing No.240781 dated 23.02.2026. 7. Respondent No.2 acknowledges the receipt of the pay order. - 7 - HC-KAR NC: 2026:KHC:11196 WP No. 12827 of 2021 8. Accordingly, the writ petition is disposed off in terms of the compromise petition. 9. In view of the disposal of the writ petition, pending interlocutory applications, if any, stands disposed off.
