2. The present writ petition has been filed seeking a direction to respondent no.1/BSES Yamuna Power Limited (‘BYPL’) to issue a new electricity connection at House No. 130, 3rd Floor, Site No. 1, Shankar Road, New Delhi or restore the electricity connection. 3. It is stated that there is an ongoing civil dispute between respondent no.2 and the petitioner. Respondent no.2 had filed a suit for recovery of possession along with other consequential reliefs against the petitioner in which a decree of possession has been passed in favour of respondent no.2 under Order XII Rule 6 of the Code of Civil Procedure, 1908.
4. It is further stated that the petitioner has filed an appeal against the said judgment which is pending adjudication before this Court in RFA 87/2024. In the said suit, the petitioner filed an application seeking similar relief, i.e. grant of electricity connection which was dismissed by the Trial Court vide order dated 5th August, 2026.

Counsel appearing on behalf of BYPL as well as private respondent no.2 object to the maintainability of the present writ petition and submit that since there is already an adjudication on merits by the Trial Court, the proper remedy for the petitioner would be to challenge the said order or file an application in the pending RFA.
6. In the opinion of this Court, since there is a judicial order passed rejecting the application of the petitioner for grant of electricity connection, the proper course of action for the petitioner would be to challenge the said
order.
7. Accordingly, the present writ petition is disposed of while granting liberty to the petitioner to challenge the aforesaid order passed by the Trial Court.
