The present application has been filed under Sections 482 and 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as BNSS)on behalf of the applicant seeking grant of anticipatory bail in connection with E-FIR No. 125/2025, registered at Police Station Special Cell, New Delhi, for the offences punishable under Sections 318(4), 319, and 340 of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as BNS).

Learned counsel for the petitioner submits that, as per the prosecution case, the complainant, Sh. Gopal Singh Rawat, was allegedly cheated of an amount of ₹2,73,00,000/- (Rupees Two Crores and Seventy-Three Lakhs only) in an online financial fraud, pursuant to which E-FIR No. 125/2025 was registered at Police Station Special Cell, New Delhi, for offences under This is a digitally signed order. Learned counsel for the petitioner further submits that the petitioner has no role in the alleged offence and that the amount received in his business account was subsequently transferred to another account. He further submits that the petitioner has no connection with the co-accused or with the persons who allegedly contacted the complainant and, therefore, has no role in the alleged incident. 6. Per contra, learned APP for the State submits that the complainant was allegedly cheated of an amount of ₹2,73,00,000/- (Rupees Two Crores and Seventy-Three Lakhs only), which was transferred to 19 different bank accounts of Layer 1, one of which belongs to the petitioner, who received a sum of ₹20,00,000/- (Rupees Twenty Lakhs only). He further submits that the investigation is still in progress, and as per the data available, there are four complaints against the bank account belonging to the petitioner. He further submits that the allegations are serious in nature, as the petitioner’s account was allegedly used in relation to the aforesaid cheating amount of ₹2,73,00,000 (Rupees Two Crores and Seventy-Three Lakhs only). 7. This court has heard both the parties and perused the material on record. 8. The charge-sheet against the other co-accused persons stands filed, and some of the co-accused persons have already been released on regular bail. An amount of ₹2,73,00,000/- (Rupees Two Crore Seventy-Three Lakhs only) was cheated from the account of the complainant, and an amount of ₹20,00,000/- (Rupees Twenty Lakhs only) was also transferred to the account of the petitioner. As per the NCRP data, there are other complaints registered before the Court in respect of the bank account of the petitioner. 9. of ₹20,00,000/- (Rupees Twenty Lakhs only) in the petitioner’s bank account, the existence of other complaints in respect of the said account, and the fact that investigation is still in progress, no ground for grant of anticipatory bail is made out at this stage. 10. The petition is accordingly disposed of. Pending application(s), if any, also stand(s) disposed of. 11.
