The instant application has been filed under Sections 483 & 484 of the BNSS, 2023 for grant of bail in connection with Cyber P.S. Case No. 151 of 2025 registered under Sections 111(2)(b), 111(3), 111(4), 319(2), 318(4), 338, 336(3), 340(2), 61(2) of BNS 2023 and Section 66B, 66C, 66D and 84(C) of the I.T. Act pending in the court of learned Additional Sessions Judge-II-cum- Cyber Crime, Special Court, Deoghar. 2. It has been contended on behalf of the petitioner that merely on the basis of the false allegation, the petitioner has been implicated in the present case. 3. It has been submitted that identically placed other co-accused persons, namely, Anup Kumar Das, Saroj Kumar Das & Ujjawal Kumar Das have been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 27.02.2026 in B.A. No. 1029 of 2026, B.A. No. 1027 of 2026 & B.A. 1028 of 2026, respectively. 2026:JHHC:18597 Page | 2 4. Further, submission has been made that the petitioner is having no criminal antecedents. 5. Submission has also been made that charges has already been framed and the petitioner is languishing in judicial custody since 19.11.2025, as such, the present petitioner may also be enlarged on bail. 6. Learned Additional Public Prosecutor appearing for the opposite party-State although has vehemently opposed the prayer for grant of bail, but she is fair enough to admit the fact that the petitioner is having no criminal antecedents and other similarly placed co- accused persons have already been granted bail by the Co- ordinate Bench of this Court. 7. This Court has heard the learned counsel for the parties. 8. This Court has taken into consideration the fact that the identically placed co-accused persons namely Anup Kumar Das, Saroj Kumar Das & Ujjawal Kumar Das have been granted bail on 27.02.2026 by the Co-ordinate Bench of this Court in B.A. No. 1029 of 2026, B.A. No. 1027 of 2026 & B.A. 1028 of 2026 respectively, and the petitioner is languishing in judicial custody since 19.11.2025 and the charge has already been framed against the petitioner, is of the view that the present application deserves to be allowed. 9. Accordingly, the instant bail application stands allowed. 2026:JHHC:18597 Page | 3 10. In consequence thereof, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum- Cyber Crime, Special Court, Deoghar in connection with Cyber P.S. Case No. 151 of 2025 with the condition that the petitioner shall co-operate in the trial and shall not absent himself on the date fixed without any cogent cause. In failure, the learned trial court is at liberty to take appropriate steps in accordance with law so that the trial be not hindered.
