The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.30/2025, registered at Police Station Dongripali, District- Sarangarh-Bilaigarh (C.G.) for alleged commission of offence punishable under Section 20(B), 29 of NDPS Act. Case of the prosecution, in brief, is that on 11.07.2025, the police of Police Station Dongripali, District Sarangarh-Bilaigarh (C.G.), acting upon a secret information, conducted a checking operation near Dongripali School. During the said operation, the police allegedly intercepted certain persons and vehicles, during the course of checking, the police allegedly seized three packets containing ganja weighing in total 3 Kilograms and 30 Grams from the possession of the co-accused persons namely Dinesh Singh Thakur, Vikram Singh Balmik and Sunny Sahu. The said seizure was effected on the spot and the aforesaid co-accused persons were apprehended by the police, on the basis of the said seizure, Crime No. 30/2025 was registered at Police Station Dongripali for offences punishable under Sections 20(b) and 29 of the NDPS Act.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case and the entire prosecution case rests solely on the memorandum statements of co- accused persons. It is further submitted that the applicant was neither apprehended at the spot nor was any contraband recovered from his possession. She would submit that charge sheet has already been filed and, therefore, custodial interrogation of the applicant is no longer required. She would submit that the applicant has no criminal antecedents and is ready to abide by any condition imposed by this Court and the applicant is a permanent resident of Sonarpara, Ratanpur, District Bilaspur (C.G.) and there is no likelihood of absconding or tampering with evidence. She would submit that the applicant is aged about 29 years and his wife is suffering from serious health ailments and is undergoing continuous medical treatment and
3 the applicant is the sole caretaker of his wife, therefore, she prays to enlarge the applicant on anticipatory bail.
4. On the other hand, learned State counsel opposes the application for grant of anticipatory bail to the applicant.
5. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue.
6. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application. Accordingly, the present anticipatory bail application is dismissed. Sd/- Sd/-
