Notice confined to respondent No.1, which is waived by learned Assistant Advocate General.
In view of the limited grievance of the petitioner projected at this stage, there is no requirement to issue notice to respondent No.2. Reply to the writ petition is also not required to be called for from the appearing respondent. The matter has been heard accordingly.

This writ petition has been filed for the grant of following substantive reliefs: -

“(a) Issue an appropriate writ, order or direction in the nature of Mandamus directing respondent No.1 to take up and decide, within a time bound period, the petitioner’s application for interim stay filed along with revision petition No. 2001108 of 2026 under Section 17 of the Himachal Pradesh Land Revenue Act, 1954 before the mutation proceedings fixed for 30.07.2026 by the Executing Authorioty. (b) Pending such consideration, stay the operation and implementation of the order dated 30.11.2023 passed by the Assistant Collector 2nd Grade, Saraswati Nagar, as affirmed vide
order dated 20.08.2025 by the Sub-Divisional Collector, Jubbal, together with all consequential mutation proceedings, including those fixed for 30.07.2026.”

The grievance raised by learned counsel for the petitioner is that the petitioner has instituted a revision petition under Section 17 of the Himachal Pradesh Land Revenue Act, 1954 against the order dated 20.08.2025 passed by the Sub Divisional Collector, Jubbal, before respondent No.1. Along with the revision petition, an application for grant of interim relief has also been filed. Though the revision petition has been entertained by respondent No.1 and has been listed before it on 28.05.2026, 02.07.2026 and 06.07.2026, the application for grant of interim relief is still pending
consideration, and the matter has now been posted for 08.10.2026. No interim relief has been granted to the petitioner. Meanwhile, the Field Revenue Agency is proceeding ahead with the attestation of mutation proceedings pursuant to the impugned order dated 20.08.2025 passed by the Sub Divisional Collector, Jubbal.

Learned Assistant Advocate General, on the basis of the instructions imparted to him, submits that in case the petitioner appears before the Divisional Commissioner, Shimla, on 29.07.2026, his application for grant of interim relief, which is pending adjudication before the said authority, shall be considered and an appropriate order shall be passed thereon, in accordance with law.
Learned counsel for the petitioner submits that in view of above submissions made by learned Assistant Advocate General, the present writ petition may be disposed of by permitting the petitioner to appear before respondent No.1, i.e. the Divisional Commissioner, Shimla, on 29.07.2026.

For the forgoing, in case the petitioner takes such recourse, his application for interim relief filed in Revision Petition No. 2001108 of 2026 shall be considered and an appropriate order shall be passed thereon, in accordance with law on 29.07.2026.
The instant petition is disposed of in above terms. Pending miscellaneous application(s), if any, also stand disposed of.
