Mr. Raman Jamalta, learned counsel, appears and waives service of notice on behalf of the respondents. 2. By way of present petition, the petitioner has prayed that he has not been paid the remaining retiral benefits and the issue raised in the present petition is covered by the judgment passed by a Division Bench of this Court in CWP No.3050 of 2014, titled, Nek Ram vs. State of Himachal Pradesh and Others, 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 decided on 17.07.2014 and the subsequent judgment of this Court dated 25.08.2021, passed in CWP No.4377 of 2021, titled, Sh. Subhash Chand vs. The Himachal Road Transport Corporation, Shimla and others along with connected petitions, in which the respondents were directed to pay the retiral benefits to the petitioners within a period of six months and in case, the required retiral benefits are not paid to the petitioners within the aforesaid period of six months, then in addition to the due statutory benefits, the petitioners shall also be paid interest @9% per annum beyond the period of six months, till the date of actual payment. 3. Learned counsel for the respondents has not disputed the aforementioned submissions and the decisions passed by this Court. 4. Consequently, the present petition is disposed of with a direction to the respondents to pay the entire retiral dues to the petitioner including gratuity, arrears of pension and leave encashment along with prescribed rate of interest within a period of six months from the due date till the actual payment. In case, the amount due is not paid within the aforesaid period 3 of six months, the respondents shall be liable to pay the same with interest @9% per annum, till the date of actual payment. 5. In view of the above, the petition is accordingly disposed of. Pending application(s), if any, shall also stand disposed of. 27 th July, 2026 ( Jiya Lal Bhardwaj ) (ankit) Judge
