The petitioner is apprehending his arrest in connection with Giridih (M) P.S. Case No. 29 of 2026, registered for the offence under Sections 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 4, 21(A), 21(6) and 22 of the Mines and Minerals (Development and Regulation) Act, 1957, Rule-4, 54 and 7 of Jharkhand Minor Mineral Concession Rules, 2004, Rule 7/9 of the Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017, pending in the court of learned S.D.J.M., Giridih. 3. Learned counsel appearing for the petitioner submits that eight tractors have been seized and the petitioner is the driver of one of the tractors and it has been alleged that 100 CFT sand on each of the tractor was being carried. He next submits that the said sand was booked by another person. He further submits that the petitioner earns his livelihood by way of driving the said tractor. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that eight tractors have been seized including the [ 2026:JHHC:18330 ] -2- tractor of the petitioner and allegations are made that 100 CFT sand on each of the tractor was being carried. 5. Considering that the petitioner is the driver of one of the tractors, on which, 100 CFT sand was being carried and it has been pointed out that the petitioner earns his livelihood by way of driving the said tractor and further the sand was booked by another person, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Giridih, in connection with Giridih (M) P.S. Case No. 29 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
