In this writ petition, the petitioners have prayed for the following prayer: “A. For issuance of an appropriate writ(s), order(s) and/ or direction(s), particularly a writ in the nature of Mandamus commanding upon the respondent No.-3 for issuance of current rent receipt in favour of the petitioner no.1 for the land pertaining to Khata No. 21/87 , Plot No.- 9/697, Mouza- Jhalpo P.S.- Telaiya, Thana No. 01, measuring an total area 04 Decimals of land and in favour of the petitioner no.2 for the land pertaining to Khata No. 21/87, Plot No.- 9/697, Mouza- Jhalpo, P.S. Telaiya, Thana No.- 01 measuring an total area 04 Decimals of land situated at District Koderma for which separate application dated 21.08.2025 & 22.08.2025 (Annexure 7 series) are still pending before the respondent No.- 3 taking into consideration the various Orders passed by this Hon'ble Court recent being order passed in W.P.(C) No. 7259 of 2023 being Order dated 18/04/2024 as the Respondent authorities especially the Respondent No-2 & 3 are in Contempt of Court by violating the various Orders passed by the Hon'ble Court by still not passing appropriate order 2026:JHHC:18159 2 upon the pending representation in view of the Order passed by the Deputy Commissioner, Koderma pursuant to Order dated 29/09/2011 contained in Memo No. 2620 which has already been set aside by the Hon'ble Court various occasions on as apparent from the various Orders passed by this Hon'ble Court as Annexed herewith. 3. It is the grievance of the petitioners that though their name appears in the Register-II maintained by the Revenue Officers yet rent in respect of the said land has not been accepted by the Department nor the rent receipts have been issued. 4. It is the case of the petitioners that the lands pertaining to Khata No. 21/87, Plot No. 9/697, Mouza Jhalpo, PS Telaiya, Thana No. 01 area 4 decimal each were purchased by the petitioners on 2003 and the same were mutated in their name and they were regularly paying rent till 2010-11. Thus, the respondents are duty bound to accept the rent from the petitioners and issue rent receipts to them. 5. Considering the prayer made by the petitioners, in my opinion the issue has to first decided by the Circle Officer, Koderma Anchal, Koderma. Thus, the petitioners are directed to approach the Circle Officer, Koderma Anchal, Koderma who after verifying the records, if finds that rent is receivable from the petitioners and there is no other impediments, he will accept the rent from the petitioners and thereafter issue rent receipts. 6. If for any other reasons if there are impediments and it is not possible to receive rent and issue rent receipts, to the petitioners on justifiable grounds, the same should be communicated to the petitioners. 7. The entire process should be concluded within 12 weeks from the date of receipt of the copy of this order. 8. Accordingly, this writ petition is disposed of.
