Government Pleader for Finance and Planning. 3 BSB,J W.P.No.5089 of 2026 The Court made the following Order: This writ petition is filed under Article 226 of the Constitution of India to issue an appropriate writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents for withholding the admitted amount of Rs.5,90,000/- (Rupees Five Lakhs Ninety thousand only) for supply of H.D.P.E. Tarpaulins under the TRFA-OS in G.Nut Corp schemes under farm implements to the FIGs during Rabi 2021-2022 through Direct Benefit Transfer (D.B.T.) mode to the farmers on subsidy basis is illegal, arbitrary and violation of Articles 14, 19 and 21 of the Constitution of India and consequently to direct the respondents to pay Rs.5,90,000/- (Rupees Five Lakhs Ninety thousand only) with interest and any other relief and to pass such other order or orders which this Court deems fit in the interest of justice. 02. The case of the petitioner, briefly stated, is as follows:- The petitioner was doing business in supply of agricultural inputs. The respondent No.1 framed guidelines under S.M.A.M. and R.K.V.Y. schemes for the year Rabi 2021-2022 through D.B.T. mode by co-ordinating / identifying and purchasing supply / delivery of the machinery to the farmers. The petitioner is one of the suppliers of the materials recognised by the respondents. The following details pertain to the admitted amounts and divisions-wise supply in Ananthapur. Particulars CFMS / PFMS Details Amount in Rs. Supplied to Yadiki mandal of Gooty Division, Anantapur District, Andhra Pradesh supplied during Rabi 2021- 2022. VAAPAN00020018 1,47,500/- Total 5,90,000/- 03. The respondents created a web-portal called as D.B.T. All the material supplied by the petitioner firm was reflected in the web portal. The petitioner came to know that the respondents Nos.1 and 3 followed the instructions of the respondent No.2 to all the officials in the State not to generate any numbers and upload in C.F.M.S due to insufficient funds to pay the amount to the contractors, suppliers etc., The petitioner, individually and with the union, submitted oral and written representations to the respondents for payment of the amount due. Even then, as the amount was not paid, this writ petition was filed. 04. The learned Assistant Government Pleader for Agriculture placed on record a copy of the written instructions of the Director of Agriculture, Andhra Pradesh, Guntur / respondent No.3 vide Lr. No. NFSNM / 1 /2026, dated 24.02.2026 wherein it is mainly stated that the amount is due, but there are no willful lapses or disobedience for the delay in payment occurred as the petitioner had not approached the respondents. In the written instructions, a request was made to grant 4 to 6 weeks time to facilitate the respondents for verifying the records available with the district authorities for obtaining necessary approvals from the Government to clear the pending dues of the petitioner. 05. The learned Assistant Government Pleader for Agriculture requested to pass appropriate order basing on the written instructions. 06. Ms.K.Sri Lakshmi, the learned counsel representing the counsel for the petitioner requested to direct the respondents to forthwith make payment in view of the admission of the liability to pay the amount to the petitioner. 5 BSB,J W.P.No.5089 of 2026 07. Since the amount payable to the petitioner is due for long time, it is a lame excuse to place blame on the petitioner to approach the respondents for release of the amounts. When the respondents can verify their records and release the amount for making payment of the amount due to the petitioner, it is a case fit to dispose of the writ petition with certain directions to the respondents. 08. Accordingly, the writ petition is disposed of directing the respondents to make the petitioner payment of Rs.5,90,000/- (Rupees Five Lakhs Ninety Thousand Only) with interest as per the agreement, if any, on or before 30.03.2026. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ ___ JUSTICE B.S.
