The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondent no.1 for production and release of the petitioner, who has been alleged to be illegally and arbitrarily detained in FIR No. 62/2026, Police Station Parliament Street. 3. The learned counsel for the petitioner submits that the FIR on which the petitioner has been illegally detained has, in fact, been quashed by the Supreme Court vide order dated 01.09.2026, passed in Writ Petition (Criminal) No. 280/2026 titled Shailendra Mani Tripathi v. Union of India & Ors. 4. Mr. Sanjay Lao, learned senior counsel appearing for respondent no. 1, refutes the said submission and, on instructions from the SHO, Police Station Parliament Street, submits that this particular FIR has not been quashed by the Supreme Court. 5. He further submits that the petitioner was produced virtually on 05.09.2026 before the learned Magistrate, and one day police remand was granted. Thereafter, on 06.09.2026, one day judicial remand was granted. He submits that today, the petitioner has been produced before the Special Judge, and the learned Special Judge has extended the period of judicial remand by a period of 14 days, as informed to him by the learned counsel for the complainant. 6.

has been raised in the present petition, the learned counsel for the petitioner fairly submits that this particular ground has not been raised in the petition. 7. Be that as it may, once the learned senior counsel appearing for respondent no. 1 affirms that this FIR has not been quashed by the Supreme Court, and this ground has not even been taken in the Writ Petition, as also the fact that the petitioner is in custody pursuant to the orders passed by a competent Court, we would not like to entertain this present petition, but leave it open to the petitioner to raise these grievances before the appropriate Court. 8. We may herein note that the petitioner has also raised a grievance about the copy of FIR No. 91/2026 registered at Police Station Parliament Street, not being supplied to him. We fail to understand as to how this prayer is maintainable in a Writ of Habeas Corpus. 9. Accordingly, we dismiss the present petition, leaving it open to the petitioner to avail of his legal remedies in accordance with law.
