1. This is First anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.689/2025 registered at Police Station – Chikhli, District- Rajnandgaon (C.G.) for the offences punishable under Sections 64(2) (m), 351(2) of BNS, 2023.
2. Prosecution case in brief is that the the applicant that the applicant/accused is having a Family dispute with his wife and the applicant/accused's wife Chandni has been living separately from the VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.03 18:48:34 +0530
2 applicant/accused for the past four months and the applicant/accused's wife has falsely implicated him in a planned manner by sending her younger sister who lives in the same locality as the applicant/accused. The applicant has a small child named Kabir who is 11 months old. That the applicant/accused's brother, sister-in- law, and mother live with him in his home. On dated 11/11/2025, when the applicant/accused returned home from Shirdi at 11:30 a.m., the applicant/accused's sister-in-law, victim, who is in Class 9, had left for school. She came to the applicant/accused's house on the pretext of using the washroom and after using the washroom went back to the house along with the applicant/accused's wife and cousin brother-in- law Pinku and a crime has been registered against the applicant/accused. Without any investigation, the Chikhli police station has registered a crime against the applicant/accused under rape, criminal intimidation and POCSO Act. As the applicant/accused fears his arrest, this bail application is being presented by the applicant/accused before the Honorable court. Complaint was related to a women and child, F.I.R. it was not upload again.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case. He would submit that he applicant/accused is having a dispute with his wife and chandni, the wife of the applicant/accused, has been living separately from the applicant/accused for the last 04 Months and has been falsely implicated by the wife of the applicant/accused in a planned manner by sending her younger sister, who is located in the same locality of applicant/accused, to her house. The applicant has a small child named kabir, whose age is 11 Months. Further more
3 investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail.

On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that as per the statement recorded under Section 183 of BNS of the victim, wherein she deposed that there was love affair between the applicant and victim and she became pregnant and her pregnancy was also terminated later on. Therefore, the present anticipatory bail application of the applicant is liable to be rejected.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts & circumstances of the case, gravity of offence,
submissions made by learned counsel for the parties, the allegations levelled against the applicant, who is the brother-in-law (Jija) of the victim, a minor girl, in her statement recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, the victim has stated that there was a love affair between her and the applicant, however, since the victim is a minor, her consent, even if assumed, is legally immaterial
7. and it has further come on record that she became pregnant and the pregnancy was subsequently terminated, as such, I am not inclined to grant anticipatory bail to the applicant.
8. Accordingly, the anticipatory bail application of the applicant– Rajesh Mandavi filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.689/2025 registered at Police Station – Chikhli, District- Rajnandgaon (C.G.) for the offences
4 punishable under Sections 64(2)(m), 351(2) of BNS, 2023. is rejected.
9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
