03/23.06.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.
2. The petitioner is apprehending his arrest in connection with Maranghada P.S. Case No.16/2025 corresponding with NDPS Case No.71/2025, registered for the offence under Sections 15(c), 22, 25 of NDPS Act, pending in the Court of the learned Spl. Judge (NDPS) Act, Khunti.
3.
Learned counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. She further submits that the allegations are made that on the tractor, 210 Kgs of poppy husk was loaded. She then submits that the petitioner has nothing to do with the said poppy husk. She next submits that the petitioner has already sold the tractor to another person by way of an agreement. On these grounds, she submits that anticipatory bail may kindly be granted to the petitioner.
4.
Learned counsel appearing for the State opposed the prayer and submits that in paragraph 5 of the counter affidavit, it has been disclosed that the petitioner is the registered owner of the said tractor on which poppy husk was loaded. He further submits that the quantity of contraband is commercial and in view of that, the prayer for anticipatory bail may kindly be rejected.

5. On the query made by the Court, learned counsel appearing for the petitioner submits that the agreement of sale of tractor is not annexed with the petition.
6. Further, by way of an agreement registered vehicle cannot be transferred. The transfer is required to be made in the record of the concerned District Transport Office. The agreement of sale of the said tractor has also not been annexed with the petition. The petitioner is said to be the owner of the said tractor. The quantity of contraband is commercial in nature. In the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected.
6. Accordingly, this application is dismissed.
