1. This hearing has been conducted through hybrid mode. 2. The present bail application has been filed by the applicant under Section 482 of the Bharatiya Nagrik Suraksha Sanhita, 2023 (hereinafter, referred to as ‘BNSS’), seeking grant of anticipatory bail in FIR No. 0198/2026, registered at Police Station Uttam Nagar, District Dwarka , Delhi, initially for offences punishable under Sections 117(2), 333 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter, referred to as ‘BNS’) with Sections 64(1) and 304(2) of BNS subsequently added during investigation. The offence under Section 117(2) of BNS was subsequently substituted by Section 117(3) of BNS upon receipt of the medical opinion regarding permanent loss of vision in the left eye of the injured. 3. 01.05.2026 wherein the complainant and her husband were allegedly assaulted, resulting in serious injury to the husband’s left eye. The applicant was not named in the FIR and was implicated subsequently during investigation. His plea that he was in Hyderabad on the date of the incident was verified from his CDR/location, attendance record and the statement of a co-worker. Apart from the statements of the complainant and injured, no independent material is stated to have surfaced showing his presence at the place of occurrence. 4. The Status Report filed by the State specifically records that the applicant was with one Akil Ali at Hyderabad from 01.05.2026 to 12.05.2026 and was working as a labourer at the Telangana Institute of Medical Sciences during the said period. In view of the aforesaid verification recorded in the Status Report, this Court is inclined to grant anticipatory bail to the applicant. 5.
In the facts and circumstances of the case, in the event of arrest, let the petitioner be released on anticipatory bail, subject to his furnishing a bail bond to the sum of Rs. 10,000/- with a surety of the like amount to the satisfaction of the concerned Station House Officer (SHO) / Investigating Officer (IO) and subject to the following conditions: i) The Applicant shall join the investigation as and when directed by the IO and shall provide his mobile number and permanent residential address to the IO. (ii) The Applicant shall remain available on the mobile number(s) shared by him with the Police. iii) The Applicant shall not directly or indirectly make any attempt to influence the witnesses or tamper with the evidence in any manner. iv) In the event of any change in his residential address or contact This is a digitally signed order.
