Petitioner has filed this writ petition seeking following reliefs: “10.1) That, this Hon'ble Court may kindly be pleased to consider the health report of medical board and direct to the 2 respondent authority to transfer the petitioner in his home district Durg in accordance with clause 1.10 of the transfer policy. 10.2) That, the Hon'ble court may kindly be pleased to direct the respondent authority to deciding a representation/Application involves a fair, reasoned prayer of the petitioner for his transfer within stipulate time limit in the interests of justice. 10.3) Any other relief(s), including the cost of this petition, as deemed fit and proper by the Hon'ble Court, in the circumstances of the case.” 2. Learned counsel for the petitioner submits that, petitioner working as Senior Medical Officer and posted at Government Primary Health Centre, Singhanpur, Block: Tokapal, District: Bastar is suffering with serious medical ailment and therefore, he has submitted an application for his transfer to Durg. Petitioner is posted at present place of posting since 2023 and have completed about three years of the service at present place. He contended that even otherwise, the petitioner has completed the tenure. Petitioner aged about 61 years, is suffering with Acute Ischemic Stroke in Middle Cerebral Artery of Brain (Brain Hemorrhage), and suffering with Type II Diabetes and Hyper Thyroidism (HT), also patient of Advance Bilateral Osteoarthritis in both knee due to which he is facing difficulty in movement and doctors have suggested for replacement of Bilateral total knee and is also suffering from High Blood Pressure. It is also contention of counsel for the petitioner, that in Clause 1.9 of the transfer policy, State Government has provided that, if any Government servant is suffering from serious medical ailment and submits application for transfer, it will considered. The petitioner has already submitted an application for request of his transfer through proper channel vide Annexure-P/2 and is forwarded by Chief Medical and Health Officer, District Bastar, Jagdalpur on 3 23.01.2026, however, no action has been taken on the application. Looking to the nature of serious disease with which petitioner is suffering, his shifting to other place where the better medical facilities are available is urgently needed. 3. Counsel for the State submits pursuant to observation made by this Court on the last date of hearing, he has sought instructions from the concerned authority and according to his instructions, if petitioner submits a fresh application before respondent No. 1 and 2, it will be considered at the earliest. 4. On due consideration of submissions of counsel for the parties, considering the facts and circumstances of the case, Clause 1.9 of the transfer policy and the circular of government dated 03.06.2015 for employees above 55 years of age, petitioner to be about 61 years of age and the submission made by counsel for the State on instructions, the writ petition is disposed of permitting the petitioner to submit fresh representation requesting for his transfer along with the copy of the writ petition and all supporting documents before respondent No. 1 and 3, in turn, the concerned authority shall consider and take decision on the representation (request for his transfer) within further period of three weeks, from the date of receipt of the representation. 5.
