1. This hearing has been done through hybrid mode. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking grant of anticipatory bail in FIR No. 190/2026, registered at P.S. IGI Airport, New Delhi under Sections 137(2), 143(4), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’). During the course of investigation, Section 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015 was also added. 3. Learned Senior Counsel for the Applicant submits that the chargesheet against the co-accused persons already stands filed and that, out of eight accused persons shown in Column No. 12, six have already been granted bail. He further submits that the Applicant has joined the investigation as and when called by the Investigating Officer (IO) and keeping in view the fact that he has joined the investigation, the interim protection granted to her be made absolute. 4. Per contra, learned APP for the State submits that the role attributed to the applicant is distinct from that of co-accused Manju Sharma. It is submitted that the applicant is alleged to be the intended buyer and beneficiary of the transaction and, therefore, the discretionary relief of anticipatory bail ought not to be granted to her. 5. Heard learned Senior Counsel for the Applicant and learned APP for the State. 6. It is a matter of record that the main accused person has already been granted regular bail by the learned ASJ-06, Patiala House Courts, New Delhi vide order dated 23.05.2026. The other co-accused persons in the present case have also been granted regular bail.
It is also stated that the chargesheet qua the co-accused persons already stands filed. 7. Keeping in view the fact that the Applicant has joined the investigation as and when called by the IO, in the event of her arrest, the Applicant shall be released on bail subject to her furnishing a bail bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/SHO concerned, and subject to the following conditions: i) The Applicant shall join the investigation as and when directed by the Investigating Officer and shall provide her mobile number and permanent residential address to the IO. (ii) The Applicant shall remain available on the mobile number(s) shared by her with the Police. This is a digitally signed order. iii) The Applicant shall not directly or indirectly make any attempt to influence the witnesses or tamper with the evidence in any manner. iv) In the event of any change in her residential address or contact details, the Applicant shall promptly intimate the same to the concerned IO/SHO. v) The Applicant shall not leave the country without prior permission of the learned Trial Court. 8. Accordingly, the present application is allowed in the above terms and stands disposed of. Pending application(s), if any, also stand disposed of. 9. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application. 10.
