Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner seeks to organise a cultural programme at 13, Raja Manindra Road, Indira Maidan on 26th January, 2026 from 4 pm. to 11 pm. The land admittedly belongs to Kolkata Municipal Corporation. The petitioner approached the corporation as well as the police authority for necessary permission but no response was received. It is submitted on behalf of the corporation that the corporation shall remain open for a brief period on Saturday (24/01/2026) and the petitioner may approach the corporation seeking necessary permission. Learned counsel for the State submits that subject to grant of permission by the corporation, the police has no objection if the petitioner organises the programme subject to certain restrictions. 2 Upon consideration of the submission made on behalf of the parties, this Court directs that the petitioner is at liberty to seek permission to hold the cultural programme before the Kolkata Municipal Corporation. Subject to such permission being granted by the corporation, the petitioner shall organise the cultural programme at 13, Raja Manindra Road, Indira Maidan on 26th January, 2026 from 4 pm. to 10 pm. subject to the following conditions: i) Number of participants shall not be more than two hundred at any point of time; ii) Sound system used in the programme shall be within the permissible limits; iii) The programme shall not cause any disturbance to the passersby, the neighbours or the public at large in any manner whatsoever; iv) The programme shall be confined to the ground indicated in the writ petition and shall not spill over to the adjoining roads lest free flow of traffic is impaired. v) The police authority shall deploy sufficient police personnel in and around the place in order to ensure peace and tranquility; vi) The list of at least ten volunteers be furnished to the police personnel along with their mobile phone numbers. The said volunteers shall be responsible in the event of any untoward incident in connection with the programme; 3 vii) The participants shall comply with the directions given by the police personnel at the spot; viii) The participants shall disperse within two hours on completion of the programme; ix) The ground shall be appropriately cleaned and shall be restored to its original condition within twenty- four hours of the programme; With the above directions, the writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
