“this Hon’ble Court may be pleased to issue a Writ of certiorari and to Declaring the action of the 4th Respondent in CF.No.4053/2025, dt. 10.11.2025, CF.No.4261/2025 dt. 20.11.2025, CF.No.4262/2025, dt. 20.11.2025, Return the Petition under section 151 CPC (Receive Additional documents and mark in a suit U/o 18 rule 17 of 151 CPC (re call) and 151 CPC (re-open) which was filed by the Defendant and to Receive the Documents and Mark the documents in a suit (Memo dated 30.10.2025 and lA dated 10.11.2025) as Illegal, Arbitrary and Violative of Principles of Natural Justice; consequently and to Direct the 4th Respondent to Receive the Additional documents along with a Memo on 30.10.2025, and Petition U/Sec.151 CPC CF. No.4053/2025 dt. 10.11.2025, CF.No.4261/2025 dt. 20.11.2025 CF.No.4262/2025 dt. 20.11.2025 by the Defendant and to Mark the documents in OS No.78/2014 on the file of VIIth Additional District and Sessions Judge Court, Gudur, SPSR Nellore District, AP to decide the suit on merits and pass”

2. None had appeared on behalf of petitioner on last two occasions, i.e., on 08.01.2026 and 27.04.2026. 3. On 27.04.2026 it was directed that petition be listed on 29.04.2026 under the caption for dismissal. Following order was passed on 29.04.2026:
“When the petition was taken at first call, Sri V. Subhramanya Prasad, learned counsel for petitioner appeared through Video Conferencing, however, his audio connection was defective leading to Pass Over of the matter. Now at second call, none appears on behalf of the petitioner. In the interest justice, adjourned to 05.05.2026.”
4. Today, despite the matter being called twice, none appears on behalf of petitioner. It appears that petitioner is not interested in pursuing this writ petition any longer. 5. Writ petition is accordingly dismissed in default and for non-prosecution. This order shall, however, not preclude petitioner from availing any alternate remedy/remedies, if any, as may be available to him in accordance with law. No costs.
