This petition has been filed under Articles 226 and 227 of the Constitution of India read with Section 101 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (“BNSS”), praying for the following relief: “a) Issue a writ in the nature of Habeas Corpus or any other appropriate writ, order or direction, directing Respondent to produce the minor children, (aged about years) and Master (aged about years), before this Hon'ble Court; b) Pass appropriate directions restoring custody of/regular and unimpeded access to the minor children in favour of the Petitioner, in the interest of the welfare of the children; c) Issue a writ in the nature of Mandamus or any other appropriate writ, order or direction, directing Respondent Nos. 1, 7 and 8 to register the Petitioner's complaint dated 27.07.2026 in accordance with law, investigate the matter, and take all necessary This is a digitally signed order. From a bare reading of the petition, it appears that there is a matrimonial dispute between the petitioner and the respondent no. 2. These cannot be settled in a writ of Habeas Corpus. The petitioner must invoke the remedy which is provided in accordance with law. 3. The learned senior counsel for the respondent no. 1 has filed a Status Report dated 07.09.2026 which inter alia states that the respondent no. 2 is presently residing at her paternal house with the children. She has also confirmed that there are domestic issues between the petitioner and the respondent no. 2. The respondent no. 2 has even filed a complaint case number 1135/2026 before the Karkardooma Court, Delhi. The Status Report is taken on record. 4. Keeping in view the abovementioned Status Report, we are not inclined to entertain the present Writ Petition. The same is dismissed, leaving it open to the petitioner to avail of his remedies in accordance with law before the competent Court.
