Heard Mr.Syed Afaque Hussain Rizvi, learned counsel for the petitioners as well as Mr.Saurabh Sahu, learned Panel Lawyer appearing for respondents No.1 and 2/State. 2. The present petition has been filed by the petitioners under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :- “1.Quash FIR No. 0584/2025 dated 29.11.2025, chargesheet dated 05.01.2026 and all consequential proceedings arising out of the said FIR/Chargesheet, pending in the Court of JMFC, Dongargarh, District Rajnandgaon (C.G.) 2. Pass any other order(s) as this Hon'ble Court may deem fit and proper in the interest of justice.” 3. In the present case, there appears to be several defects and learned counsel for the petitioners has not cured the defects till date. 4. At this stage, learned counsel for the petitioners seeks permission of this Court to withdraw this petition with liberty to file a fresh petition curing all defects. 5. Permission is granted. 6. Accordingly, the instant petition is dismissed as withdrawn with liberty to file a fresh petition curing all the defects, subject to depositing a sum of Rs.2,000/- as cost by the petitioners in the 3 Registry of this Court and the same shall be transmitted to the Government Special School for Intellectually Retarded Girls, Gangapur, Ambikapur, District Surguja (C.G.). 7. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioners after retaining the photocopies of the same.
