The petitioner has been made accused in connection with Giridih (M) P.S. Case No.110 of 2026 registered for the offences punishable under Section 103 (1), 118 (1), 116 (2), 351 (2) and 3 (5) of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner, in furtherance of common intention with the co-accused persons, has committed the murder of Dilip Das. It is submitted that the allegation against the petitioner is false. Drawing attention of this Court towards para-16 of the instant bail application, learned counsel for the petitioner submits that the petitioner has no criminal antecedent. It is next submitted that the place of occurrence is the premises of Kabribad Mines of the C.C.L which is out of bound for any person not authorized by C.C.L and the deceased Dilip Das is no way associated with C.C.L. It is further submitted that this is the counter-blast case of Giridih P.S. Case No.109 of 2026 lodged by the Hawaldar of C.C.L. Giridih Area and there is direct allegation against the deceased of the deceased along with the accused of Giridih P.S. Case No.109 of 2026 trespassed to Kabribad Mines Area of C.C.L after cutting the barbed wire fencing and indulged in commission of theft of the coal from the crusher and when the same was protested by the security personnel of C.C.L., they attacked the security personnel of C.C.L causing injuries to several of them. It is also submitted that the copy of the F.I.R. of Giridih P.S. Case No.109 of 2026 has been annexed as Annexure-3 of this Bail Application and kept at page-60 of the brief and as a counter-blast, this false case has been foisted against the petitioner who is a Security Guard, Category-I, Giridih Area. It is then submitted that the petitioner undertakes that he will co-operate with the trial of the case and that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. It is lastly submitted that the petitioner has been in custody since 09.05.2026 as has been mentioned in para-05 of the instant bail application. Hence it is submitted that the petitioner be released on bail. Learned Addl. P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Giridih, Jharkhand in connection with Giridih (M) P.S. Case No.110 of 2026 with the condition that he will co- operate with the trial of the case, furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
