1. This hearing has been done through hybrid mode. 2. The present application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’), seeking grant of anticipatory bail to the applicant in FIR No. 190/2026 registered at Police Station IGI Airport, New Delhi for offences punishable under Sections 137(2), 143(4), 61(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’). During the course of investigation, Section 81 of the Juvenile Justice (Care and Protection of Children) Act, 2015 was also added. 3. accused persons shown in Column No. 12, six have already been granted bail. He further submits that the Applicant has joined the investigation as and when called by the Investigating Officer (IO) and keeping in view the fact that he has joined the investigation, the interim protection granted to him be made absolute. 4. Per contra, learned APP for the State submits that the role attributed to the Applicant is distinct from that of the co-accused who have been granted bail. It is submitted that the applicant is alleged to have played an active role in the conspiracy and, therefore, the discretionary relief of anticipatory bail ought not to be granted to him. 5. Heard learned Senior Counsel for the Applicant and learned APP for the State. 6. It is a matter of record that the main accused person has already been granted regular bail by the learned ASJ-06, Patiala House Courts, New Delhi vide order dated 23.05.2026.
The other co-accused persons in the present case have also been granted regular bail. It is also stated that the chargesheet qua the co-accused persons already stands filed. 7. Keeping in view the fact that the Applicant has joined the investigation as and when called by the IO, in the event of his arrest, the Applicant shall be released on bail subject to his furnishing a bail bond in the sum of Rs. 25,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/SHO concerned, and subject to the following conditions: i) The Applicant shall join the investigation as and when directed by the Investigating Officer and shall provide his mobile number and permanent residential address to the IO. (ii) The Applicant shall remain available on the mobile number(s) This is a digitally signed order. shared by him with the Police. iii) The Applicant shall not directly or indirectly make any attempt to influence the witnesses or tamper with the evidence in any manner. iv) In the event of any change in his residential address or contact details, the Applicant shall promptly intimate the same to the concerned IO/SHO. v) The Applicant shall not leave the country without prior permission of the learned Trial Court. 8. Accordingly, the present application is allowed in the above terms and stands disposed of. Pending application(s), if any, also stand disposed of. 9. Needless to state, nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case, and the observations made herein are confined to the consideration of the present bail application. 10.
