This is the first bail application filed under Section 483 of Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.132/2020 registered at Police Station Shankargarh, District Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 392, 420, 120(B) of Indian Penal Code, 1860. 2. The prosecution story in brief, is that on 10.12.2020, complainant called the present applicant and one Ashutosh Singh for worship of peace in his house and after completion of the same, they went to river for disposal of worship's articles, at that time, the accused persons pulled the complainant, due to which he fell down and the accused persons have looted his chain, statue of Lord Ganesh and Goddess Laxmi and cash of Rs.1,71,000/-. Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the crime in question. It is further submitted that co-accused namely Ashutosh Singh has already been granted bail by this Court vide order dated 22.02.2021 passed in MCRC No.338/2021. He also submits that the applicant has no criminal antecedent, he is in jail since 11.10.2025, charge sheet has already been filed and conclusion of the trial is likely to take some time, therefore, the applicant be released on bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. Considering the facts and circumstances of the case, considering the age of the present applicant, his detention period, entire investigation has been completed, charge sheet has already been filed and further considering the fact that co-accused namely Ashutosh Singh has already been granted bail by this Court and conclusion of the trial is likely to take some time and he has no criminal antecedent and there is no apprehension of the applicant tampering with the evidence or absconding, without expressing any opinion on merits of the case, this Court inclined to allow the instant bail application. 7. Accordingly, the instant bail application of the applicant is allowed. Let the Applicant – Sanjay Kumar Mishra, involved in Crime No.132/2020 registered at Police Station Shankargarh, District Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 392, 420, 120(B) of Indian Penal Code, 1860, be released on bail on furnishing personal bond with one local surety in the like sum of Rs.25,000/- to the satisfaction of the concerned trial Court with the following conditions:- (i) he shall not directly or indirectly make any inducement, threat or promise to any person 3 acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (ii) he shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (iv) he shall not involve himself in any offence of similar nature or otherwise in future else the State would be at liberty to move application for cancellation of bail. 8.
