NJS,J W.P No.4896 of 2026 3
The Court made the following Order:
The present writ petition is filed aggrieved by the action of the respondent Nos.3 and 4 in disconnecting the power supply to the borewell vide Service Connection No.2611334001004 by de-rooting the electricity transformer over the lands in an extent of Ac.2.34 cents in Survey Nos.740, 741, 1307, 1306, 1248, 1285, 1249 and to an extent of Ac.2.1300 cents in Survey No.788-2 of Nandyalampeta Village fields, Mydukur Mandal, Y.S.R. Kadapa and seeking to declare the same as arbitrary, etc., and for consequential direction to restore the electricity connection by re-erecting the electricity transformer.
2. Heard learned counsel for the petitioners. Also heard Mr. K Ashok,
learned counsel representing the learned counsel for A.P.S.P.D.C.L.
3. The learned counsel for the petitioners made submissions with reference to the averments made in the affidavit filed in support of the writ petition and the material filed along with the same. He submits that the petitioners are in possession and enjoyment of the subject matter lands which were assigned to them and the concerned revenue authorities have issued Pattadar Passbooks and Title Deeds in their favour. He has also drawn the attention of this Court to the 1B Namoona and other Adangals reflecting the names of the petitioners, as per pattadars and enjoyers. 4. The learned counsel submits that while that being the position, the respondent Nos.2 to 4 have highhandedly interfered with the possession of
NJS,J W.P No.4896 of 2026 4
the subject matter properties and disconnected the power supply to the service connection through which the petitioner is drawing the water to the borewell. Notwithstanding the same, the learned counsel submits that the respondents have de-rooted the brick platform on which the transformer is erected apart from de-rooting the electric poles through which the electric wires are drawn with the help of JCB. He submits that before resorting to the said highhanded action, no notice was issued to the petitioners and they have reason to believe that at the behest of local politicians, the respondent Nos.2 to 4 have resorted to the same. 5. He further submits that the petitioners raised a Mango garden and also installed Dip Irrigation System. He submits that unless a direction is issued to the respondents to restore the power supply, the standing crop would be affected. 6. On the other hand, Mr. K Ashok, learned counsel representing the learned Standing Counsel for A.P.S.P.D.C.L., placed a copy of the communication dated 19.02.2026 received from the respondent No.4, for perusal of the Court, the relevant portion of said communication reads as follows:
“One No. complaint given to higher authorities about utilizing Electricity supply illegally by the two Petitioners in Forest lands in Nandyalampeta fields in Mydukur Mandal. Accordingly the APSPDCL and revenue department authorities jointly inspected and
NJS,J W.P No.4896 of 2026 5
disconnected the electrical supply to Two No’s Agriculture fields related to Petitioners.”
7.
Thus, a reading of the above extracted matter goes to indicate that the respondent authorities more particularly, respondent Nos.2 to 4 have resorted to the action of disconnection of electricity supply without even issuing notice to the petitioners. There is no mention about conduct of joint inspection in the presence of the petitioners. It is further surprising to note that, there is no denial of the allegations made in the affidavit, more particularly with reference to the de-rooting of transformer and the electrical poles. 8. Even, if the petitioners are utilizing the electricity supply, other than for their lands, at least the authorities concerned are expected to put them on notice before resorting to any action. 9. In fact, this Court noticed that in several cases, the concerned authorities of DISCOM apart from disconnecting the power supply to the service connection are taking away the transformers, without notice and any
order, that too without any irregularity was proved against the concerned consumers. Such actions are not just or legal and cannot be countenanced, as the same are contrary to established principles of natural justice.
10. In the present case, as seen from the communication which is referred to above, the authorities have not acted by following the due procedure. Though, in the normal circumstances, the Court would be inclined to grant some time for filing counter-affidavit, as it is a clear case of resorting to
NJS,J W.P No.4896 of 2026 6
highhanded action, no useful purpose would be served by adjourning the matter.
11. In fact, this Court is inclined to impose costs, however, considering the request made on behalf of the learned counsel for the DISCOM, no costs are imposed.
12. In the facts and circumstances of the case, more particularly as it is stated that the standing crop will be affected, this Court deems it appropriate to direct the respondents to restore the power supply to Service Connection No.2611334001004 by re-erecting transformer at their own cost, as expeditiously as possible within a period of three (03) days from today. Needless to observe that the respondents are at liberty to initiate appropriate action, in accordance with law.
13. The learned counsel representing the DISCOM authorities shall intimate the orders passed by this Court, so that they will take necessary action without any further delay.
14. With the above directions, the Writ Petition is disposed of. No costs. Miscellaneous petitions pending, if any, shall stand closed.
Registry is directed to dispatch a copy of this order to the Chairman and Managing Director, A.P.S.P.D.C.L., Tirupati. __________________________
