The present writ petition seeks setting aside of the show cause notice dated 22nd August, 2026, calling upon the petitioner to explain as to why the services shall not be terminated from SSB in view of the communication issued by Additional District Commissioner, Cachar, wherein it is informed to the respondent that domicile certificate, upon verification, reflect that that the petitioner is not domicile of the said place. 2. Heard. 3. The counsel for the petitioner has invited our attention to a document dated 7th March, 2026 issued by the office of Deputy Commissioner, Cachar, Silchar which is produced as Annexure P-3. 4. According to him, the said document certifies that he is resident of the very same place, which is disputed in the aforesaid show cause notice and as such, he would urge that the said show cause notice is liable to be quashed and set aside. 5. The learned counsel for the respondents would object to the maintainability of the petition. According to them, the same is preferred against a show cause notice and whatever grievance the petitioner intends to canvas can be looked into by the competent authority, who has issued the said show cause notice including that of the document which is produced at Annexure P-3. 6. Having considered the rival claims, we are of the view that the present petition can be said to be not maintainable as preferred against a show cause notice. 7. The petitioner has every right to submit his explanation to the aforesaid show cause notice, as the said show cause notice is based on concrete evidence that is referred to in paras 11 and 12 therein. It is always open for the petitioner to counter the said evidence, which is referred to in said paras of the show cause notice, by relying on the document which are produced in the present petition as Annexure P-3 and also by any other document which he intends to rely upon. 8.
Keeping such liberty open to the petitioner, we deem it appropriate not to cause any interference in extraordinary jurisdiction. 9. The petition accordingly stands dismissed. 10. Pending application, if any, also stands disposed of. 11.
Order be uploaded on the website of this Court, forthwith.
