Heard the parties. 2. The prayer of the petitioners, in this writ petition are as follows:- “a. For issuance of an appropriate writ(s) / order(s) / directions(s) commanding upon the learned District Consumer Disputes Redressal Commission, Purbi Singhbhum (hereinafter referred to as ‘Learned District Commission) to keep at abeyance the further proceedings in connection with Consumer Complaint Case No.42 of 2025 presently pending before Learned District Commission during the pendency and final disposal of Revision Petition preferred on behalf of the petitioners under Section 47(b) of the Consumer Protection Act, 2019, vide Revision Petition No.01 of 2026, arising out of and directed against the order dated 18.12.2025 passed by the learned District Commission in Consumer Complaint Case No.42 of 2025 whereby and whereunder application dated 21.08.2025 preferred on behalf of petitioner No.1 and 2/ opposite party Nos.1 & 2 seeking recall of the Order dated 30.07.2025, wherein the said petitioners have been debarred from filing their written statement, as well as the application dated 13.11.2025 preferred on behalf of petitioner No.3/ Opposite Party No.3 seeking recall of the Order dated 26.09.2025, wherein the said petitioner had been proceeded ex parte have been rejected and is presently pending adjudication before the learned Jharkhand State Consumer Disputes Redressal Commission, Ranchi (hereinafter referred to as the “Learned State Commission”), as the regular Bench for hearing is presently not available before the learned State Commission on account of incomplete quorum And; b. For ad-interim reliefs, during the pendency of this writ petition, to stay the further proceedings of Consumer Complaint Case No.42 of 2025 presently pending before ‘Learned District Commission’ And/or c. For such further and other reliefs, as this Hon’ble Court may deem fit and proper in the nature and circumstances of the case.” 3. It is their case that since their written statement was not accepted and the Consumer Forum proceeded without giving an opportunity to the petitioners to lead evidence, they had filed a Revision Application before the Jharkhand State Consumer Disputes Redressal Commission, Ranchi. 4. It is their grievance that since the State Commission is not functioning, this Court may stay the proceeding which is continuing before the Consumer Forum, Jamshedpur till the State Commission passes an appropriate order on the revision. 5. Learned counsel appearing on behalf of opposite party No.3 submitted that admittedly, the petitioners have filed a written statement after 20-25 days after the period prescribed in the law. 2026:JHHC:17557 3 Thus, the Tribunal did not accept the same. 6. Keeping the matter pending or passing any order directing the State Commission to dispose of the Revision Application will consume much more time as the State Commission is non- functional due to want of Coram. 7. At this stage, the respondents submits that they will not insist to nonsuit the petitioners-herein on the above issue before the Consumer Forum, Jamshedpur, East Singhbhum, if a direction is given to the Consumer Forum to dispose of the complaint of the petitioners at the earliest. 8. Considering the said submission and the agreement arrived at between the parties, this writ application is disposed of with a direction to the Consumer Forum to accept the written statement which has already been filed. The petitioners-herein will adduce their evidence on day-to-date basis before the Consumer Forum. The Consumer Forum thereafter will try to dispose of the Consumer Complaint Case No.42 of 2025, preferably within a period of three months from the date of receipt of a copy of this order. 9. It is made clear that the Consumer Forum will not give unnecessary adjournment to any of the parties. 10. Both the parties i.e., petitioners and respondent No.3 will produce a copy of this order before the Consumer Forum, Jamshedpur, East Singhbhum, immediately. 11.
