IN THE HIGH COURT OF ORISSA AT CUTTACK
BLAPL No.4363 of 2026
Arjun Naik … Petitioner
Mr. R. Pradhan, Advocate
-versus- State of Odisha … Opposite Party Mr. C. Mohanty, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL) : 13.05.2026
01.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Jhumpura P.S. Case No.19 of 2025 corresponding to S.T. Case No. 116 of 2025 pending in the file of learned SDJM, Champua, for commission of offences punishable U/Ss. 126(2)/118(1)/109(1)/351(2)/103(1) of BNS, on the main allegation of committing murder of the deceased by burning her.
3. Heard, Mr. Ramakanta Pradhan,
learned counsel for the petitioner and Mr. C. Mohanty, learned Addl. PP in the matter and perused the record together with the copy of deposition of witnesses PWs.1 to 12 as supplied.
4. Mr. Pradhan by referring to the evidence of the witnesses submits that since no one has testified against the petitioner, he may kindly be admitted to bail, but
facts remains that the statement of the deceased was recorded by the IO and the same is very much available on record. In view of the above facts and taking into
consideration the nature and gravity of the offences as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the dying declaration of the deceased implicating the petitioner being recorded by the IO and keeping in view the other circumstances on record in entirety, this Court is not inclined to grant bail to the petitioner.
5. Hence the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately transmitted to the Court in seisin over the matter for reference.
