For Petitioner : Mr.S.Arunnithy For Respondents : Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor 1/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.1833 of 2026 ORDER By consent, this writ petition is taken up for final disposal at the admission stage itself. 2.Seeking direction to the respondents 1 to 3 to consider and take action based on the complaints dated 06.09.2025 and 27.09.2025 sent by the petitioner, the present petition is filed. 3.The learned counsel for the petitioner submitted that the petitioner had purchased a Tata Ace vehicle bearing registration No.TN57BV0487 for his work on 04.09.2018. He had obtained a loan from Cholamandalam Invest and Fin Co.Ltd., and was paying EMI to the said company without any arrears. Two people, namely, S.Kumar and K.Surya approached the petitioner to purchase the said vehicle. However, the petitioner denied to the same. Thereafter, they asked the petitioner to give the vehicle for test drive and hence, the petitioner gave the vehicle to them on 28.08.2026. However, they had never returned it back. Aggrieved over the same, the petitioner had given a complaint to the third respondent police on 06.09.2025. Since there was no action, he further sent an representation to the respondents 1 to 3 on 27.09.2025. Due to the inaction, the petitioner has approached this Court by way of filing the present petition. 2/6 https://www.mhc.tn.gov.in/judis W.P.Crl.(MD)No.1833 of 2026 4.The learned Additional Public Prosecutor, on instructions, submitted that the entire narrative put forth by the petitioner is completely false and only to evade his liability as against the Cholamandalam Invest and Fin Co.Ltd., he had arranged the said S.Kumar and K.Surya, who are none other than his own uncle and uncle's son, and had handed over the said car to them voluntarily. All these facts were revealed in an enquiry, which was conducted by the third respondent police, and after conducting a proper enquiry, the petitioner's complaint has been closed. 5.Heard either sides and carefully perused the materials available on record. 6.Considering the submission of the learned Additional Pubic Prosecutor that it is a case of default in payment of EMI, it is for the petitioner to work out his remedy before the appropriate civil Court.
