DATED : 06th OCTOBER, 2026 PER COURT :
1. Learned Advocates appearing for the parties jointly submit that the present application, which is filed for quashing of the First Information Report bearing No. 0279 of 2026, registered with Pundliknagar Police Station, Chhatrapati Sambhajinagar, for offences punishable under Sections 85, 115(2), 352, 351(2) read with Section 3(5) of Bharatiya Nyaya Sanhita (BNS) and the subsequent charge sheet along with R.C.C. No. 2023 of 2026, pending on the file of the learned Judicial Magistrate First Class, Chhatrapati Sambhajinagar.
2. Further, both the learned Advocates jointly submit that the parties have amicably settled the dispute among themselves and have filed the affidavit and consent terms before the Registrar, which have been verified, and the report has also been placed before this Court. On perusing report of compromise, the verification of the identity of the husband and wife as well as the terms of compromise has been completed and affirmed. The Tandale
-3- 925-APPLN-3825-2026 affidavit-in-reply setting out the terms of settlement is also verified and affirmed. The said affidavit of Respondent No.2 clearly suggests that, in pursuance of the discussions and settlement between the parties and their respective family members, Respondent No.2 has agreed to give her consent for quashing and setting aside the FIR registered against all the applicants. Respondent No. 2 has also stated on oath that she does not wish to prosecute or pursue the present criminal proceedings and does not intend to initiate any further proceedings against the applicants in relation to the present dispute. Thus, she accords her no objection to the quashing of the FIR.
3. Taking into consideration the affidavit-in-reply and the fact that the original dispute between Respondent No.2 and her husband arises out of matrimonial discord, I am inclined to exercise my inherent jurisdiction to quash the proceedings. Hence, the following order :-
ORDER (i) The Criminal Application stands allowed. (ii) The FIR bearing No. 0279 of 2016, dated 03.06.2026, registered with Pundliknagar Police Station, Chhatrapati Sambhajinagar, along with the consequential charge-sheet and Tandale
