The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.17/2026, registered at Police Station Komakhan, District : Mahasamund (C.G.) for alleged commission of offence punishable under Section 20(b)(ii)(c) of NDPS Act. 2. As per the brief facts of the prosecution case, the Assistant Sub Inspector Nagendra Kumar Dubey received an information on dated 01.02.2026 that 04 persons in a white coloured TATA ZEST car number CG 10 AS 9099 were coming from Odisha towards VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.03.16 17:08:58 +0530 2 Chhattisgarh carrying illegal narcotic substance Ganja. On the above information, the police official were standing at the blockade near Komakhan Chowkhari, when after some time, as per the information given by the informer, 04 persons in a white coloured TATA ZEST car number CG 10 AS 9099 came from Odisha, on stopping them and asking for their name and address,a the driver told his name as Prashant Nanda, the person sitting next to the driver gave his name as Dhananjay Nag S/o Partha Nag, the person sitting in the rear seat of the car gave his name as Deepak Mahanand S/o Khusiram Mahanand and Shankar Harpal S/o Kundal Harpal, residents of Odisha. Based on information from an informer, on searching the trunk of white coloured TATA ZEST car number CG 10 AS 9099, a total of 25 kg of illegal narcotic substance like ganja was found in two white coloured plastic bags. Which was recovered and seized from the joint possession of the accused and they were duly arrested and at Police Station Komakhan, District Mahasamund (C.G.) bearing crime number 17/2026, crime under section 20 (B) (II) (C) and 29 of NDPS Act was registered against the accused Prashant Nanda, Dhananjay Nag, Deepak Mahanand and Shankar Harpal. Hence, this first bail application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He submits that no any contraband has been seized from the conscious and exclusive possession of the applicant. It is further contended that only on the basis of memorandum statement of the co-accused persons, present applicant is falsely been implicated in this case. He also submits that applicant has no criminal antecedent, therefore, he prays for grant of anticipatory bail to the applicant. 3 4. On the other hand learned State counsel opposes the application for grant of anticipatory bail to the applicant. 5. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue. 6. In the light of observation made by the Supreme Court in Anarul SK (supra), I do not find any good ground to entertain this anticipatory bail application.
