Affidavit of service filed by the petitioners is taken on record. The Panchayat is not represented. Learned counsel for the petitioners submits that the petitioners are recorded owners of the plot in question. The Panchayat has constructed a pucca road through their land without their consent. The petitioners submitted a representation in this regard before the District Magistrate, Bankura on 14th February, 2026 which was forwarded to the Block Development Officer Joypur, district Bankura on 18th February, 2026. The representation is yet to be considered. Upon consideration the submission made on behalf of the parties, this Court is of the view that it appears that the petitioners are recorded owners of a portion of the land in question. The land is required to be demarcated by the concerned authority in presence of the petitioners in order to ascertain whether the road in question is passing through the portion occupied by them. Since the
2 representation submitted by the petitioners before the concerned authority is pending, the Block Development Officer, Joypur, being the 5th respondent herein, is directed to consider and dispose of the representation within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law. In the event it is found that the land of the petitioners or any portion thereof is encroached upon by the authority, necessary steps shall be taken at the earliest. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
