Petitioner who is holding post of Assistant Teacher (Art) has filed this writ petition challenging the impugned order of transfer dated 03.06.2025, under the rationalization policy, whereby petitioner has been transferred from Govt. Middle School, Kumharpara, Block Gariyaband to Govt. Middle School, Naginbahra, Chhura,. 2. Learned State counsel submits that in the rationalization policy, State Government has constituted three committees ie., district level committee, PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA Date: 2026.02.28 18:27:31 +0530 2 / 2 divisional level committee and the state level committee. Representation submitted by petitioner before the divisional level committee headed by Divisional Commissioner is rejected on 10.09.2025. Petitioner can file appeal/ representation before the State level committee headed by Director, Directorate Public Instruction (DPI). 3. Learned counsel for petitioner submits that in view of submission of learned counsel for respondent-State, petitioner may be granted liberty to file appeal/ representation before the State level committee headed by DPI and direction be issued to the state level committee to consider and take decision on the representation at the earliest within specified time. 4. On due consideration of the submission of learned counsel for the respective parties, this writ petition is disposed of reserving liberty with the petitioner to submit representation before the State level committee headed by DPI and if such representation is submitted the concerned committee shall consider and take decision on the representation/ appeal of petitioner, in accordance with law, expeditiously, preferably within a further period of 04 weeks from the date of receipt of representation/ appeal. 5.
