This petition has been preferred by petitioner under Article 226 of the Constitution of India seeking following reliefs :- “10.1 That, this Hon'ble Court may kindly be pleased to issue appropriate writ / order/ direction to the respondent state authority to permit the petitioner and member of Schedule Caste and Schedule Tribe to enter in the community hall of Village Manikpur Chote, Gram Panchayat Pikrimal, District Sarangarh- Bilaigarh without any obstructions. 10.2) That, this Hon'ble Court may kindly be pleased to issue appropriate writ by directing the respondent state authority to take appropriate punitive action against the respondent No. 12 looking to the facts and circumstances of the case expeditiously within a stipulated period. 10.3) That, this Hon'ble Court may kindly be pleased to issue appropriate writ by directing the respondent state authority to take possession of government public community hall which is situated at Village Manikpur Chote Gram Panchayat Pikrimal, Tehsil Sariya, District Sarangarh- Bilaigarh (CG). 10.4) That, this Hon'ble Court may kindly be pleased to issue any other suitable writ/orders/directions in favour of the petitioner looking to the facts and circumstances of the case.” 3 3. Learned counsel for the petitioner would submit that the petitioner is a permanent resident of Village Manikpur Chote, Gram Panchayat Pikrimal, Police Station Sariya, District Sarangarh-Bilaigarh (CG), and belongs to the ‘Ganda’ caste, which falls under the Scheduled Caste category. He would further submit that a ‘community hall’ has been constructed by the Panchayat Department in Village Manikpur Chote, Gram Panchayat Pikrimal, for the use of villagers, but respondent No.12, Rohit Patel, has locked the said community hall and is not permitting the petitioner to enter or use it. Thus, respondent No.12 is depriving the petitioner of his fundamental rights. He next submitted that various complaints have been made to the Gram Panchayat and P.S. Sariya, but no action has been taken by them. Learned counsel also submitted that the petitioner is ready to file a fresh representation before the respondent No.3, the Collector, District Sarangarh-Bilaigarh. Hence, he prays that the present petition may be disposed of with a direction to respondent No.3 to decide the representation filed by petitioner within a period specified by this Court. 4. Learned counsel appearing for the State-respondent(s) would submit that if the petitioner files a fresh representation, the same shall be duly considered and decided, and the grievance of the petitioner shall be redressed in accordance with law. 5. Having considered the limited prayer made by learned counsel for the petitioner, this petition is disposed of by granting liberty to the petitioner to file a fresh representation, along with a copy of this order, before respondent No.3-Collector, District Sarangarh-Bilaigarh, within a period of 15 days from today for redressal of his grievance. Thereafter, the Collector, Sarangarh-Bilaigarh, shall consider and address the 4 grievance of the petitioner, within a further period of 15 days by taking strict action in accordance with law. 6. The State counsel is also directed to apprise the concerned Collector for expeditious redressal of the grievance of the petitioner. 7. With aforesaid observation and direction, the writ petition stands disposed of. 8. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
