Petitioner Mr. Angshuman Chakraborty …for the petitioner Mr. Sanjoy Bardhan Ms. Suveni Banerjee ..for the State Learned counsel appearing on behalf of the petitioner relies on medical prescriptions and claims that the petitioner is in an immobile condition. It was merely an accident that caused death of the constable. Copy of prescriptions are taken on record. Upon instructions from the Investigating Officer, learned counsel appearing on behalf of the State submits as follows. The petitioner was found having picnic in the Sundarbans and the Maithon in the months of December in 2025 and January in 2026. Tower location of his phone also reveal that he was roaming around at different places and evading arrest. The motorbike in question belonged to the father of the principal accused and the principal accused did not even possess any licence to drive the same. Yet, he drove the same at a high speed, recklessly and caused the death of a traffic police constable. The CCTV footages of the said incident have also been collected. 2 The prescriptions relied upon by the petitioner do not even bear any name of the person or the doctor who issued them, although there is a name of one New Avenue Nursing Home mentioned therein. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. (Jay Sengupta, J.)
