Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 2 months and only one witness out of the cited 21 witnesses till date has been examined in part. It has also been submitted that the de facto complainant/P.W.1 has taken out an application under Section 175(3) of the Code of Criminal Procedure when the examination-in- chief was in progress. Learned advocate for the State has produced the case diary and drawn the attention of the Court to the injury report as well as the seizure list. Having taken into account the gun shot injury received 2 by the injured at a vital organ of the body, I am not inclined to release the petitioner on bail at this stage. State is directed to expedite and progress with the trial of the case. Petitioner would approach this Court at the appropriate stage. Accordingly, CRM(M)2219 of 2025 is dismissed at this stage.
