1. This is an application filed by the petitioner under Section 151 of CPC, 1908 seeking medical assessment board to complete the assessment of the petitioner. 2. For the reasons stated in the application, issue notice. 3. Ms. Narain, learned CGSC accepts notice on behalf of the respondents and states that pursuant to the Order dated 31.08.2026, the petitioner was called by the assessment board but it transpired that the temporary UDID card of the petitioner had already expired and hence the assessment did not take place. 4. Mr. Saha, learned counsel for the petitioner, draws my attention to the Guidelines on Assessment of Persons with Benchmark Disabilities (“PwBD”) for admission to the MBBS Course, 2026 and more particularly guideline No. 9.6 which reads as under:-

PwBD category solely on account of a procedural defect or discrepancy in the Permanent UDID Card, provided that such defect is capable of rectification and the specified disability is otherwise established in accordance with law.”
5. I am of the view that the abovesaid guideline permits the candidate to be considered under PwBD category even if there is a procedural defect or discrepancy in the permanent UDID card. The petitioner was having a temporary UDID card with learning disability graded approximately at greater than 40% till 28.05.2026 and the petitioner has also applied for a fresh UDID card which is taking time. 6. For the said reasons, the petitioner had made out a case to fall under the guideline 9.6. 7. Let the assessment board comply with the Order dated 31.08.2026 within 1 week from today. 8.
