(Crime No.299 of 2025). ...Ist Respondent/Complainant 2.C.Raj ...IInd Respondent/ De-facto complainant PRAYER: Criminal Original Petition filed under Section 528 of BNSS, 2023, praying this Court to call for the records relating to the impugned charge sheet in C.C.No.2683 of 2025, dated 11.6.2025 on the file of Judicial Magistrate Court No.I, Madurai and quash the same. 1/5 https://www.mhc.tn.gov.in/judis For Petitioners : Mr.K.Krishna For Respondent-1 :Mr.B.Thanga Aravindh Govt.Advocate(Crl.side) O R D E R The present petition has been filed by the accused No.1 to 3 in C.C.No.2683 of 2025, on the file of Judicial Magistrate Court No.I, Madurai, wherein, the Petitioners have been charge- sheeted with the offence under Sections 296(b), 115(b) and 351(b) of BNSS, 2023. 2.A perusal of the charge sheet reveals that the defacto complainant demanded repayment of the loan amount, to which the Petitioners are said to have abused the defacto complainant and attacked him with hands. 3.According to the learned counsel for the Petitioners, it is purely a civil dispute, for which, acriminal colour was given and hence, the charge sheet is liable to be quashed and the alleged incident said to have been happended does not happened. 4.I have heard the submissions made on either side and perused the materials placed before this Court. 2/5 https://www.mhc.tn.gov.in/judis 5.A perusal of the charge sheet reveals that prima facie case has been made out against the Petitioners/accused No.1 to 3 and no legal ground has been made to quash the charge sheet filed aainst them and hence, this Court is not inclined to quash the charge sheet. However, the trial Court is directed to dispose of the above said criminal proceedings without being influenced by any of the observations made in this order. The personal appearance of the A2 and A3 alone is dispensed with unless and until they are specifically required by the trial Court. 6.In view of the above facts, this Court finds no merit in the Criminal Original Petition and the same stands dismissed.
