Applicant herein, who is facing trial in a murder case, seeks interim bail in FIR No. 777/2021 dated 14.12.2021, registered at PS Mayur Vihar Phase-I, on humanitarian ground. 2. Learned counsel for the applicant submits that the incarceration period of the applicant is already of more than four years and on one earlier occasion also, he had been enlarged on interim bail when his father had, unfortunately, died on 23.04.2026, so as to enable him to perform last rituals. He submits that, thereafter, there is another unfortunate event in his family as his real sister, who was suffering from Tuberculosis, has died on 16.08.2026. He submits that the applicant had, immediately, filed an application seeking interim bail before the learned Sessions Court, but the learned Sessions Court, instead, granted him custody parole for six hours to enable him to visit Haridwar. 3. He submits that that the applicant has no previous involvement in any other criminal case of any nature whatsoever and that his widowed mother This is a digitally signed order. The trial is under-way and so far, 10 witnesses have been examined and the next date before the learned Trial Court is of 17.10.2026. 5. Nominal Roll of the applicant has been requisitioned from the Jail Authorities which also indicates that period of incarceration undergone by him is more than four years. 6. The deputed IO-SI Aman Singh is present in Court and he also informs that the applicant has no other involvement of any nature whatsoever. 7. Keeping in mind the overall facts of the case and the reasons assigned, the applicant is, hereby, granted interim bail for a period of 15 days on his furnishing personal bond in a sum of Rs. 25,000/- subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with following conditions:- I. Surety would be local. II. Applicant shall not try to contact any of the witnesses, directly or indirectly. III. He shall not leave the National Capital Territory of Delhi without prior permission of learned Trial Court. IV. Applicant shall furnish a mobile number to concerned IO on which he can he contacted, if required. Such number shall remain operational and functional during the period of interim bail. 8. The period of interim bail would be reckoned from the date of release. 9. The application is disposed of in aforesaid terms. 10.
