The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused person Sandeep Pramanik @ Fatik has committed murder and caused disappearance of the evidence of the murder by hiding the dead body. It is next submitted that the petitioner has been implicated in this case only on the basis of his confession statement made before the Police and also the confession statement of co- accused person namely, Sandeep Pramanik @ Fatik. It is next submitted that on the basis of the confessional statement of the petitioner, knife, Gaita and Kudal, as well as the tempo used in the occurrence, have also been recovered. It is further submitted that the allegations against the petitioner are all false and the petitioner has no criminal antecedent as has been mentioned in paragraph no. 14 of the bail application.
