JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the proceedings in C.C.No.12480/2021 registered for the offences punishable under Sections 149, 323, 427, 447, 504, 506 of the Indian Penal Code. 2. Heard Sri. Syed Khamruddin, learned counsel appearing for the petitioner, Sri. Channappa Erappa, learned HCGP appearing for respondent No.1, Sri. Syed Mujahid Ul Islam, learned counsel appearing for respondent No.2 and have perused the material on record. - 3 - HC-KAR NC: 2026:KHC:23072 CRL.P No. 5656 of 2026 3. During the subsistence of the proceedings, the parties to the lis have entered into a settlement and have settled the dispute by filing Joint Affidavit drawing up certain terms of settlement. The Joint affidavit filed by the parties to the lis reads as follows: “We, 1) M. A. Mohammed Amanullah, son of Late M. Abdulla, aged about 62 years, Residing at No. 4, 2nd Cross, Nandidurga Road Extension, Benson Town, Bengaluru - 560 064 and 2) Mohammed Umer Pasha, son of Mr. Gulab Pasha, aged about 30 years, residing at No. 10/3, MchPerson Road, Cooke Town, Bengaluru - 560 005, do hereby solemnly affirm and state on oath as follows: 1. We submit that the above Criminal Petition is filed by the Petitioner seeking quashing of the Complaint, FIR and Charge Sheet in C.C. No. 12480/2020 arising out of Crime No. 18/2020, pending on the file of the Hon'ble VIII Addl. Chief Metropolitan Magistrate, Bengaluru, for the offences punishable under Sections 149, 323, 427, 447, 504 & 506 of the Indian Penal Code. 2. We state that the 2nd Respondent herein is the complainant in the above case and due to certain misunderstandings and disputes between us, the above complaint came to be filed. 3. We state that with the intervention of elders, well- wishers and friends, we have amicably settled all our disputes and differences. 4. We state that in terms of the settlement, we have also resolved our civil disputes in O.S. No. 26380/2019 and have agreed to withdraw all allegations and claims against each other. - 4 - HC-KAR NC: 2026:KHC:23072 CRL.P No. 5656 of 2026 5. We state that we have no surviving grievances or claims against each other and we have decided to live peacefully without any further disputes. 6. We, particularly the 2nd Respondent/Complainant, hereby state that we have no objection whatsoever for quashing of the Complaint, FIR and Charge Sheet in C.C. No. 12480/2020 pending before the Hon'ble VIII Addl. Chief Metropolitan Magistrate, Bengaluru. 7. We state that this Joint Affidavit is executed out of our own free will, consent and volition, without any force, coercion, undue influence or pressure from any quarter. I do hereby affirm and state that what is stated above is true and correct to the best of my knowledge, information and belief. This is my true name and signature.” 4. The parties to the lis are present before this Court and are identified by their respective counsels. 5. In the light of the Joint Affidavit having been filed and offences not being against the State, I deem it appropriate to accept the Joint Affidavit and terminate the proceedings against the petitioner in the subject petition. 6.
